Specialized E-Shops: Challenges and Legal Requirements for Food, Cosmetics, and Other Sensitive Product Categories

Setting up and operating an online store (e-shop) is already a complex endeavor, requiring thorough planning and compliance with regulations on commercial transactions, consumer protection, and intellectual property. However, when an e-shop deals in sensitive product categories—such as food, cosmetics, or even dietary supplements and para-pharmaceutical items—the demands intensify, creating a more stringent regulatory framework. 

One of the most illustrative examples is the sale of food products. Beyond the general prerequisites—terms of use, privacy policy/cookie policy—the business must meticulously adhere to food safety and labeling regulations. Labels must include information on ingredients, allergens, nutritional values, storage instructions, and expiry dates, ensuring consumers are well-informed before making a purchase. If the products are perishable or otherwise sensitive, they require specialized packaging, shipping, and delivery procedures to prevent spoilage or public health risks. 

Similarly strict is the legislative framework for cosmetic products. In line with Regulation (EC) No 1223/2009, each cosmetic must meet specific safety standards and clearly list on its label information such as ingredients (INCI), any relevant warnings, and the responsible person for placing the product on the EU market. Businesses must also be extra cautious with advertising claims (e.g., “organic,” “hypoallergenic”), which must be substantiated by reliable evidence. 

Another category often overlooked but equally demanding is dietary supplements. In this area, labeling must clearly distinguish the product’s properties from medical claims that could mislead consumers. Any statements regarding health benefits must be backed by scientific data, and certain substances may require special permits or inspections before they can be sold. 

In all these scenarios, failure to comply with the relevant legal requirements can result in serious administrative penalties, fines, or even legal actions by consumers who feel misled or harmed. Consequently, robust legal guidance, continuous updates on legislative changes, and the implementation of reliable internal processes are essential for the sustainable growth of a specialized e-shop. After all, compliance is not just about avoiding fines; it is about strengthening consumer trust, a cornerstone of success in the highly competitive realm of e-commerce.
